What Happens at a Parking Tribunal

A parking tribunal is an independent adjudication service that hears appeals against parking Penalty Charge Notices (PCNs) issued by councils and Transport for London. The tribunal is completely independent of any council or enforcement authority. Tribunals were created by Parliament to ensure that motorists have access to an independent, impartial review of their parking penalty. The adjudicators are qualified lawyers (often barristers or solicitors) who are appointed to the tribunal and have no connection to any council. The tribunal process is designed to be fair, accessible, and free. You do not need a solicitor or legal representative — the process is specifically designed for members of the public to use without professional help. There are no court fees, no costs implications, and the process is generally straightforward. The tribunal can only decide one question: was the PCN correctly issued? It cannot reduce the penalty amount, order compensation, or make any other order. If the tribunal allows your appeal, the PCN is cancelled entirely. If it refuses your appeal, the penalty stands.

There are two separate tribunal services in England and Wales: **London Tribunals** (formerly PATAS — the Parking and Traffic Appeals Service) handles appeals against PCNs issued by all London borough councils and Transport for London. It covers the whole of Greater London. **The Traffic Penalty Tribunal (TPT)** handles appeals against PCNs issued by councils outside London in England and Wales. It also handles some bus lane and moving traffic penalty appeals. Both tribunals follow the same basic process and apply the same law. The main practical difference is the geographic area they cover. Both have online case management systems where you can submit and manage your appeal. Both tribunals also handle appeals against penalties for other civil enforcement matters such as bus lane contraventions, moving traffic contraventions (in London), littering from vehicles, and in some cases, blue badge misuse.

To submit a tribunal appeal, you need: Your Notice of Rejection from the council (which confirms your formal representation was rejected and gives you the right to appeal). Within 28 days of receiving the Notice of Rejection, submit your appeal online through the relevant tribunal website. You will need to create an account, provide your PCN details, and upload your evidence. Your submission should include: a clear summary of your grounds of appeal, all evidence you want the adjudicator to consider (photographs, documents, correspondence), and any legal arguments or authorities you wish to rely on. After you submit, the council will be notified and given the opportunity to respond. They will submit their own evidence pack, which typically includes: the CEO's notes, photographs taken at the time, the PCN, NTO, and any correspondence. You will be able to see the council's evidence and submit a reply if needed. You can choose whether to have your case decided on the papers (written submissions only) or at an oral hearing (by telephone, video, or in person). For most straightforward cases, a paper decision is sufficient. Request a hearing if you feel the case would benefit from being able to explain the circumstances in your own words.

Good preparation is the key to success at the tribunal. Here is how to prepare an effective evidence bundle: **Organise chronologically.** Present your evidence in the order events occurred — the contravention, the PCN, your challenge, the council's response, the NTO, your representation, and the rejection. **Include a case summary.** Write a clear, numbered summary of the key points of your case. This helps the adjudicator quickly understand the issues. **Photograph everything.** If your case involves signage, road markings, or the location, take clear, dated photographs. Wide shots showing the context and close-ups showing the detail. Include Google Street View screenshots if helpful. **Reference legislation.** If your case involves a legal point (e.g. non-compliant signage under TSRGD 2016), reference the specific regulation. You do not need to be a lawyer — a simple reference like "the sign does not comply with diagram 638 of the Traffic Signs Regulations" is sufficient. **Be honest.** If there are weak points in your case, it is better to acknowledge them and explain why they should not be determinative, rather than ignore them. Adjudicators are experienced lawyers who will identify weaknesses — being upfront about them builds credibility.

If you request an oral hearing, here is what to expect: The hearing will be scheduled at a convenient time. For London Tribunals, hearings can be in person at their offices, by telephone, or by video. For the Traffic Penalty Tribunal, most hearings are by telephone or video. The hearing is informal. There is no cross-examination, no witness box, and no formal rules of evidence. The adjudicator will introduce themselves, explain the process, and invite you to present your case. You will have the opportunity to explain your grounds of appeal and refer to your evidence. The adjudicator may ask questions to clarify points. The council may also be represented — either by a parking manager or, in some cases, a solicitor. They will have the opportunity to present their case. After hearing from both sides, the adjudicator will either give a decision immediately or reserve their decision to be issued in writing later. The written decision will set out the reasons for allowing or refusing the appeal. If you are nervous about a hearing, remember: the adjudicator's job is to find the truth and apply the law fairly. There are three possible outcomes at the tribunal: **Appeal allowed.** The adjudicator finds that the PCN should not have been issued, and it is cancelled. You must pay the full penalty amount within 28 days. The amount does not increase because you appealed — it remains at the NTO level. **Appeal allowed on different grounds.** Sometimes the adjudicator may allow your appeal for reasons different from those you raised. For example, the adjudicator might notice a procedural defect that neither you nor the council identified. There is no further right of appeal after the tribunal decision. In exceptional cases, you may be able to challenge the decision by judicial review in the High Court, but this is only available if the tribunal made a legal error — not simply because you disagree with the decision. Judicial review is costly and rare in parking cases. Regardless of the outcome, appealing to the tribunal carries no risk — you cannot be penalised for appealing, and the amount owed does not increase.
