How to Appeal a Council Parking Ticket

Council Penalty Charge Notices (PCNs) are issued by local authorities under civil parking enforcement powers. Most councils in England and Wales operate under Part 6 of the Traffic Management Act 2004, which replaced the older system under the Road Traffic Act 1991. A PCN can be served in two ways: attached to the vehicle by a Civil Enforcement Officer (CEO) — this is called a "penalty charge notice served on the vehicle" — or posted to the registered keeper by first class post within 14 days — this is called a "penalty charge notice served by post" (common for CCTV-enforced contraventions). The penalty amount depends on the severity of the contravention. In London, higher-level contraventions attract a £130 penalty and lower-level contraventions attract an £80 penalty. The informal challenge is your first opportunity to dispute a council PCN. It is not a formal legal process — it is simply a request to the council to reconsider the ticket. You can make an informal challenge by writing to the council (by letter, email, or often through their online portal) explaining why you believe the PCN should be cancelled. You should submit your challenge as soon as possible after receiving the ticket — ideally within 14 days. The key benefit of making an informal challenge within 14 days is that the early payment discount period is paused. If your challenge is rejected, you will be given a further 14 days to pay at the discounted rate. This means you lose nothing by challenging within the first 14 days. In your informal challenge, clearly state your grounds and attach supporting evidence. The council is not legally required to consider an informal challenge, but in practice they almost always do. Common outcomes are: the PCN is cancelled, a warning is issued instead, or the challenge is rejected and the council proceeds to issue a Notice to Owner.

If the PCN remains unpaid after 28 days (or after your informal challenge is rejected), the council will send a Notice to Owner (NTO) to the registered keeper of the vehicle. This is a formal document that triggers the next stage of the appeal process. The NTO must be served within a specific timeframe — generally within 6 months of the contravention (or 6 months from the date the PCN was served, if later). If the council fails to serve the NTO within this period, the PCN becomes unenforceable. The NTO must contain specific information including: a description of the contravention, the statutory grounds on which you can make a formal representation, the amount of the penalty, and instructions on how to make a representation. If any of these elements are missing, the NTO may be defective — which can itself be a ground for appeal. Upon receiving an NTO, you have 28 days to submit a formal representation. If you do not make a representation and do not pay within 28 days, the council can issue a Charge Certificate, which increases the penalty by 50%.

A formal representation is a legal submission to the council based on specific statutory grounds. Unlike the informal challenge, the council is legally required to consider a formal representation and respond. The statutory grounds for formal representation are set out in the NTO. Common grounds include: the contravention did not occur; the PCN was not served in accordance with the regulations; the penalty exceeds the relevant amount; the Traffic Regulation Order (TRO) is invalid; there has been a procedural impropriety; and the vehicle had been stolen or was being used without the owner's consent. Your formal representation should clearly identify which statutory ground(s) you are relying on and provide evidence to support each ground. Attach photographs, receipts, permits, maps, witness statements, and any other relevant documentation. The council must consider your representation and respond with a Notice of Acceptance (if they agree) or a Notice of Rejection (if they disagree). The Notice of Rejection must explain why the representation was rejected and inform you of your right to appeal to the independent tribunal.

The Traffic Penalty Tribunal (TPT) is the independent adjudication service for parking penalty appeals outside London. London appeals are handled by London Tribunals (formerly the Parking and Traffic Appeals Service, or PATAS). Both tribunals are completely independent of the councils. Adjudicators are qualified lawyers who decide cases based on the law and evidence. Their decisions are binding on the council — if the tribunal allows your appeal, the council must cancel the ticket. To appeal, submit your case within 28 days of receiving the Notice of Rejection. You can do this online through the tribunal's website. You will need to provide your grounds of appeal, a summary of your case, and upload your evidence. The council will also submit their evidence, which you will be able to see. Most cases are decided "on the papers" — meaning the adjudicator reviews both parties' written submissions and makes a decision without a hearing. However, you can request an oral hearing by telephone, video, or in person. Appealing to the tribunal is completely free. You do not need a solicitor or legal representation. The process is designed to be accessible to members of the public.
