Here's where AI changes the legal landscape significantly. If a council deploys a predictive AI system that flags a particular stretch of road as high-risk for pothole formation — and then fails to act on that information — the Section 58 defence becomes considerably harder to sustain. The authority would struggle to argue it had no knowledge of the risk when its own technology had predicted it.
Conversely, councils that actively use AI tools and respond promptly to flagged locations could find themselves better protected legally, having demonstrably discharged their duty of care.
For drivers pursuing compensation claims, the emergence of AI road-monitoring data also creates a new evidential avenue. If a council's own predictive system had identified a road section as deteriorating, and that data exists, it could be highly relevant to a negligence claim.
What Drivers Should Know: Practical Advice Right Now
While AI prediction tools are still being developed and rolled out, there are concrete steps UK drivers can take today to protect themselves — both on the road and legally.

But technology is only as useful as the institutional will to act on it. Britain's road maintenance crisis is fundamentally a funding and prioritisation problem. AI can tell a council exactly where its worst roads are; it cannot conjure the budget to fix them.
What AI can do, however, is remove the plausible deniability that councils have historically relied upon. When a predictive system has flagged a road as deteriorating, and that flag sits in a database, the legal and political pressure to respond increases substantially. That shift in accountability could prove to be the most powerful effect of this technology — not just smarter roads, but councils that are demonstrably unable to claim ignorance when things go wrong.
For drivers, the message is straightforward: the tools to protect yourself — legally, financially, and physically — are improving. Stay informed, document incidents thoroughly, and don't assume that pothole damage is simply the price of driving in Britain. The law gives you rights.
